A point of contention: This is not my view but I bring up this point because it is controversial, and I am not sure if I have heard it resolved. To the first point, “Don’t like Gay Marriage don’t get one”. The point of contention here is not the word gay but marriage. People have a natural right to all the other things on the list but do you have a right to marriage? If we are to define marriage as a comittment between two people, yes absolutely you do, but if the definition includes to be recognized by the government as well, then no. No one has the right then for the government to recognize their relationship. I am not discriminating, gay or straight, should the government be in charge of marriage if not is the word even necessary without a state. I would like to hear what others have to say on this. Nice article, I hope you don’t mind I am going off on a tangent.

You make an excellent point and its not a tangent at all. This is my thought. All powers that government has are delegated to it by the citizenry. Anything that government does that I didn’t first personally have the power to do is illegitimate.
Everyone’s fairly familiar with John Locke’s old assertion of this, but he was actually preceded by about a decade by Algernon Sidney, who in 1680 in “Discourses Concerning Government” §31 wrote: “This will be evident to all those who consider, that no man can confer upon others that which he has not in himself: If he be originally no more than they, he cannot grant to them or any of them more than they to him.”
So when I look at this matter I consider it that way. Suppose its the state of nature and I live in my cottage, and you’re my neighbor and live in your cottage over yonder. I don’t have any power to tell you who you can and cannot marry and you don’t have any right to tell me who to marry. So if we don’t have that power we can’t delegate that power to government. Therefore government is engaging in that action illegitimately.
